Creation and Delivery

Arobase Web Design will work to complete the project in good time once the client has submitted the necessary material. Before the site goes live Arobase Web Design will propose a version of the site to the Client. The Client can make observations and ask for changes. Arobase Web Design will procede to make the modifications requested. The site will then be considered accepted by the Client.

Copyright and Trademarks

The client guarantees that any elements of text, graphics, photos, designs, trademarks furnished to Arobase Web Design for inclusion in the web site are owned by the client, or that the client has permission from the rightful owner to use each of these elements.

The Client assumes the entire responsability for the choice of the keywords necessairy to the search engine optimisation of the site notably with regard to intellectual property rights. The Client guarantees Arobase Web Design against any legal action that arises from non-respect by the Client of this article of the agreement.

Arobase Web Design will register the Domain Name requested by the Client, provided it is available. The Client assumes entire responsability for the name chosen notably as regards intellectual proprerty or other rights held by third parties (trade marks, trading names…)

Arobase Web Design is not responsible for proof-reading the content of the site unless specifically agreed.

Search Engine Optimisation

Arobase Web Design will index the site with the major non-paying search engines and directories without any guarantee of positionning. A separate E-marketing contract may be agreed.

Personal Information

Conforming with article 27 of the French law on Computing and Liberties of 6 January 1978, the Client has the right of access and rectification of data concerning him which Arobase Web Design and the hosting company may have on record. To protect your privacy we do not distribute your name or e-mail address to any third party.

Responsibilities of Arobase Web Design

If Arobase Web Design is seen to be at fault in the execution of its obligations it will correct this error or deficiency as soon as possible, and the Client will have the right to compensation for the damage incurred. This compensation cannot be superior to the price paid by the Client for the creation of the site concerned.

Web Site Maintenance

This agreement allows for four minor web site maintenance changes to pages over the first year, including updating products and making minor changes to text. It does not include replacing nearly all the text from a page, major page reconstruction, new pages or navigation structure changes. Such work will be charged at current hourly rates.

Hosting

If the hosting company is chosen by the client, Arobase Web Design will do whatever is necessary so that the site remains online without interruption, but cannot accept any responsability for interruptions of the server. Arobase Web Design and the hosting company cannot be held responsible in the event of malfunction or interruption of the telephone network making the site inaccessible.

Conditions of Payment

The cost of the creation of the site is payable in two stages. At the signing of the contract a deposit of 35% is required. The balance is due when the job has been completed and the site accepted by the client. We reserve the right to suspend services iIf payment for services is not received within the terms of payment stipulated by us.

We reserve the right to amend and update these Terms and Conditions at any time without notice.
